I'm a kernel developer. I'm pretty sure that your code isn't competing with mine. I've also made it pretty clear that I have no problem with you writing this code. My irritation is directed purely at the corporate interests who want this purely because it means they can reduce the risk of attracting legal attention when they ship infringing kernels.
