Oh, right. I see what the problem is. You're interpreting what Ted said as "Both these things need to occur", whereas what Ted's saying is "If this occurs, this other thing is a defence against it". He's asserting that inability to know that the other party is unable to give consent is a statutory defence, not that both conditions are required to satisfy the scenario he's describing.
