Name a software company that doesn't have to follow this ruling. This isn't a building code or even a food safety rule, I can't think of an industry more international than software. Well at least not as transatlantic.
You're correct its the US' fault. I don't see how if you were a lawyer for a European software company (tbh I can't think of a non-multinational software company off the top of my head) the fact that it's the US to blame would give you much comfort.
