Red Hat document the changes you need to make to RHEL in order to be able to redistribute it (the requirement that you rebuild everything is an additional restriction on Red Hat's part and remains repugnant), so it's at least possible to produce a RHEL derivative that doesn't infringe Red Hat's trademarks - you just need to replace two packages. The problem with Canonical's position is that they refuse to tell anyone what the equivalent requirements are for Ubuntu.
